All rights in the World Professional Powerboating Association (“WPPA”) website and its contents, are owned or controlled by the World Professional Powerboating Association with registered offices at P.O.Box 555564, Dubai, United Arab Emirates (“XCAT Racing Promoter”).
Use of this website and its contents is provided subject to the following Terms and Conditions (“T&C”):
Where you are invited to submit any contribution to this site you are required by such submission to grant the XCAT Racing Promoter a perpetual, royalty-free, non-exclusive, sublicenseable right and license to use, reproduce, modify, distribute, transfer and exercise all copyright and publicity rights with respect to any such work and to incorporate it in other works in any media now known or later developed for the full term of any rights that may exist in such content. If you do not wish to grant such rights to the XCAT Racing Promoter, it is suggested that you do not submit your contribution to this site. By submitting your contributions, you also warrant that such contribution is:
- your own original work and that you have the right to make it available to the XCAT Racing Promoter for all the purposes specified above;
- is not defamatory; offending, profane or sexually explicit, and does not infringe any law.
You agree to indemnify the XCAT Racing Promoter against all legal fees, damages and other expenses that may be incurred as a result of your breach of the above warranty; and agree to waive any moral rights in your contribution for the purposes of its submission to and publication on this site and the other purposes specified above.
In particular, users of any forum, chat or comment area must not post any material that is insulting, offensive, confidential and encourages pyramid or other soliciting schemes or advocates illegal conduct. In addition, users of any forum, chat or comment area must not use it to advertise a product or service.
If you fail to abide by these T&C, you will be formally warned by email and may be immediately suspended from using the website and its content. If thereafter you continue to breach the T&C, you may be permanently excluded from the website and any use thereof.
The XCAT Racing Promoter reserves the right to remove any content, subsite, data and any posting, at any time, for any reason. In the event that any of these T&C should be determined to be invalid or otherwise unenforceable, then to the extent to which that T&C is invalid or unenforceable, it shall be deleted. The remaining provisions and conditions shall be enforceable to the fullest extent permitted by the Applicable Law.
These T&C shall be governed by and construed in accordance with the laws of the United Arab Emirates. Disputes arising in relation to the website shall be exclusively subject to the jurisdiction of the courts of the Dubai, United Arab Emirates.
